Property Developers
OSM Chartered Surveyors provide advice to Developers on Rights of Light matters, from pre-acquisition stage to detailed assessments on the potential effects the proposed development may have on existing surrounding properties. We provide strategic Rights of Light advice to assist developers to manage risks where a potential rights to light claim may be possible. Where applicable, we can negotiate with the affected parties on behalf of the developer where it is established a right to light has been acquired and may be infringed as a result of a proposed scheme.
We provide Developers with guidance on Daylight, Sunlight and Overshadowing matters on a new scheme, whether it relates to the impact the scheme may have on surrounding properties, or whether the scheme itself will meet the expectations of the Local Planning Authority. We provide the analytical assistance required to demonstrate whether the level of impact a development may have is acceptable or not, We provide strategic design advice to assist the developer in achieving a compliant scheme and acquiring planning consent.
OSM also provide advice to Developers on what works are likely to trigger the Party Wall etc. Act 1996. This is key in making the most of the rights available to developers under the Act, including rights of access to neighbouring properties. We can also use our expertise to administer the Party Wall process in a diligent, efficient and cost effective manner to reduce any potential delays to the works starting on site and to protect the developer from erroneous claims of damage arising at a later stage.
OSM take an integrated approach when assessing potential light issues or party wall issues in order to allow the developer to manage any potential risks at an early stage that may later cause delay during the planning stage or construction phase. Our experienced surveyors have demonstrated the ability to work coherently, effectively and successfully with Developers and their project team.
Architects
OSM Chartered Surveyors have extensive experience in working closely with Architects and the design team on Daylight, Sunlight and Overshadowing matters.
We provide the design team with the analytical assistance required to demonstrate whether the level of impact a development may have is acceptable or not, We can provide the Architect with strategic design advice, including advice on scheme optimisation and internal accommodation design. We can prepare compliant design envelopes, cutbacks and massing studies to optimise and maximise the development potential of the site.
OSM can assist Architects and their design team to find practical solutions to problematic design issues, allowing the scheme to evolve whilst respecting the Architects design vision. We also prepare Daylight, Sunlight and Overshadowing reports for pre-planning application advice and to support the full planning application. We also provide assistance with the preparation of comprehensive responses to planning officer's queries or resident's objections post submission of a planning application, providing valuable support and assistance to successfully achieve planning approval for the client.
Planning Consultants
OSM Chartered Surveyors have extensive experience in producing Daylight, Sunlight and Overshadowing reports which assist Planning Consultants in compiling planning applications.
We work closely with Planning Consultants to provide advice where necessary and assistance in reviewing the specific requirements of each project to ensure the planning guidelines are met. We prepare reports that ensure compliance and consistency with Local, Regional and National planning policies.
OSM also have experience in preparing Environmental Chapters for Daylight, Sunlight and Overshadowing matters to form part of an Environmental Impact Assessment (EIA).
We work together with Planning Consultants to prepare extensive detailed responses to planning officer's queries or resident's objections post submission of a planning application, providing Planning Consultants with the necessary support required to successfully achieve planning consent for the client.
Local Authorities
OSM Chartered Surveyors have experience in assisting Local Authorities on Daylight, Sunlight and Overshadowing matters, to ensure their schemes do not adversely impact on private residential properties and land, and to ensure that the dwellings proposed meet the relevant standards to provide future occupants with adequate standards of living space.
OSM have experience in assisting Local Authorities with independent verification studies, where we would review an applicant's Daylight and Sunlight report to asses its compliance, consistency and adequacy to support a planning application.
We also advise Local Authorities on Rights of Light and Party Wall matters. Where applicable, we can act on behalf of the Local Authority and provide the assistance and guidance required.
Private Home Owners
OSM Chartered Surveyors have extensive experience in representing private home owners on Daylight, Sunlight and Overshadowing matters, both where the home owner is the one building the extension or where the neighbour is concerned a development will affect their light or may cause undue overshadowing to their garden. We provide the analytical assistance required to demonstrate whether the level of impact a development may have is acceptable or not,
OSM have experience with representing private home owners in Rights of Light matters and providing them with Rights of Light advice in terms of the effect a proposed development may have on their property. Where applicable, we can negotiate with the developer on behalf of the private home owner if it is established that their Right to Light has been infringed.
We also have experience with representing private home owners on Party Wall matters, both if the home owner is the developer or the neighbour. We provide the assistance and guidance required to adhere to the provisions of the Act, to ensure their rights under the Act are adequately protected.
